1. Acceptance of these terms
You agree to the terms and conditions outlined in this Terms of Use Agreement with respect to the Software. This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Software and the subject matter of this Agreement.
This Agreement may be amended from time to time. The latest Agreement will be posted on the website, and you should review it regularly. Your continued use of the Software after changes to this Agreement are posted means you accept those changes.
2. Confidentiality
The Client agrees to keep confidential all trade secrets and other information that is identified as proprietary or confidential, or that the circumstances around its disclosure indicate should be treated as confidential, and to make no use of that information unless permitted under this Agreement.
3. Third-party platforms
Definition
A Third-Party Platform means any third-party website, including but not limited to social media platforms (such as Twitter, Facebook and Instagram) and online media platforms (such as news websites, blogs and forums), from which we may retrieve information as part of a search made via the Software. The list of Third-Party Platforms available with the Software may be amended from time to time without notice to the Customer. You further agree to be bound by the terms and conditions of all Third-Party Platforms made available through the Services.
API services
vinci360° uses the YouTube, Facebook and Instagram API Services, from which the Software may retrieve information. We use YouTube API Services (i.e. data from YouTube), governed by the Google Privacy Policy available at google.com/policies/privacy (opens in a new tab), and other third-party API services. If you give us access to your YouTube account, you have the right to revoke that access at any time via the Google security settings page (opens in a new tab).

Lack of guarantees
Because the Software provides information from Third-Party Platforms, you understand and acknowledge that the Services depend on the availability and completeness of the data provided by Third-Party Platforms and on the availability of the Third-Party Platforms themselves. vinci360° cannot and does not guarantee the availability, completeness or accuracy of any such data or Third-Party Platform.
Amendments
You also agree that the terms for receiving information from a Third-Party Platform depend on the terms and conditions of that Third-Party Platform agreed by us, which the Third-Party Platform can amend at any time on its own initiative. Such amendments may make it impossible, or significantly restrict the ability, to obtain information from that Third-Party Platform, which may affect the scope of the Services. This is beyond our control and we are not responsible for it.
